1. Agreement to these terms
These Terms of Service govern your use of risewise.io and any subdomains (the "Site"), operated by RiseWise ("RiseWise," "we," "us," or "our"). By accessing or using the Site, you agree to these terms. If you do not agree, please do not use the Site.
2. What this Site is
The Site describes construction services related to the building-side scope of elevator and escalator modernization. It is provided for general informational purposes only. Nothing on the Site is an offer, a bid, a proposal, a quotation, or a commitment to perform work, and nothing on the Site should be relied upon as a substitute for a written agreement.
3. No contractor relationship is created
Using the Site, submitting a form, scheduling a site walk, or exchanging correspondence with us does not create a contractor-client relationship. A relationship is established only through a written agreement signed by both parties that identifies a specific project, scope, and price.
4. No professional or code advice
Descriptions of code requirements, inspection processes, and building conditions on this Site are general and simplified. Applicable requirements vary by building, by jurisdiction, by the authority having jurisdiction, and over time. Nothing on the Site constitutes engineering, architectural, legal, or code-compliance advice, and it should not be relied upon in planning, bidding, or performing work. You are responsible for verifying requirements applicable to your project.
5. Accuracy and availability
We work to keep the Site accurate and current but make no representation that it is complete, accurate, or up to date. We may change, suspend, or discontinue any part of the Site at any time without notice.
6. Submissions and inquiries
Information you submit through the Site, including project descriptions, drawings, addresses, and inspection reports, is submitted voluntarily. Do not submit confidential, proprietary, or privileged information through the Site. We do not guarantee a response to any submission, and a response does not constitute acceptance of any work.
7. Intellectual property
The Site and its contents, including text, layout, graphics, and the RiseWise name and logo, are owned by RiseWise or its licensors and are protected by applicable intellectual property laws. You may view and print pages for your own reference. You may not copy, reproduce, republish, or distribute Site content for commercial purposes without our prior written permission.
8. Third-party names and marks
Names of elevator manufacturers, service providers, code bodies, and other third parties appear on the Site only to identify the equipment, standards, or context that our services relate to. Those names and marks are the property of their respective owners. Their appearance does not indicate any affiliation, sponsorship, endorsement, partnership, or approval by those parties.
9. Third-party links and services
The Site may link to third-party websites and services, including scheduling tools. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's own terms and privacy policy.
10. Disclaimer of warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, RiseWise and its owners, members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Site, even if advised of the possibility of such damages.
12. Changes to these terms
We may update these terms from time to time. The effective date above reflects the most recent revision. Your continued use of the Site after a revision constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada.
